UNDERSTANDING THE DOCTRINE OF SEPARATION OF POWER. ORIGIN AND REASONS FOR ADOPTION, AS WELL AS BENEFITS

Hello class, before I continue with this topic, I would want to give you a brief history of the reason why we now have something called separation of power.
The idea of separation of power came when a man called, lord acton opined that “power corrupts but absolute power corrupts absolutely”.
As a government student I believe you people had been taught the concept of power where it’ was said that power is the act of making binding decision on others irrespective of their will. Its also said that power intoxicates.
Having said that, under a democratic government you all would recall that we have three arms of government known as
Executive.
Legislature.
Judiciary.
The act of sharing the powers that exist in a country or state is known as separation of power.
In other words, it’s the division of all the political powers in a state or a country for this three arms of government.

Let me also burst your brain by telling you that this doctrine was propounded by a man called “Montesquieu “in one of his books called the spirit of the law. He also opined that when laws are enacted in tyrannical manner , that such laws will be enforced tyrannically. On the same vein , Bodin a French writer said that a prince should not administer justice on persons, either an independent judge should do so.

REASONS AND BENEFITS OF SEPARATION OF POWER .
the adoption of this principle is mainly to avoid what is called fusion of power, in a political arrangement.
The idea was also to avoid the concentration of power in one body thereby leading to what is called arbitrary rule.
What is arbitrary rule?
Make research and report to me in our next class .
Other reason for this principle is to ensure freedom and liberty of citizens through the judiciary, off course , you all knows that the judiciary is responsible for interpretation of the law and settling of disputes .
Another reason worthy to note is , avoidance of accumulation of power in one place.
It’s democratic in nature .lastly, it also ensures that they is what is called stable political system and avoid chaos in a polity as well as what we called political and civil unrest .

We have Come to the end of this class , I would like to tell you that separation is not operational in military system, totalitarian regime, monarchy system and e.t.c.
It works effectively in a place the supremacy of the constitution is been observed, such as federal system of government, confederal system, and others.

This principle has helped foster democracy in the world today , apparently, Nigeria , USA and UK has implemented this principle of separation of power.

  1. Yes, act solely; but again “check and balance” is meant to ensure equilibrium. Acting solely to my opinion leads to dreadful monopoly do to speak.
